Refund and Cancellation Policy
Skyline Legal Services
Overview
Skyline Legal Services is committed to providing high-quality legal services in accordance with the Law Society of Ontario’s Rules of Professional Conduct.
This Refund and Cancellation Policy applies to the payment of legal service fees, retainer deposits, and disbursements.
Retainers and Legal Fees
When retaining Skyline Legal Services, clients are typically required to pay a retainer fee, which is held in a trust account and applied toward legal services and disbursements as they are rendered.
Fees charged for services already performed are non-refundable. Clients are entitled to an accounting of all services rendered and disbursements incurred at any time upon request.
Refunds
Refunds may be considered in the following situations:
-
Where no services have been provided and no work has been commenced.
-
Where an overpayment has been made by the client.
-
Where funds remain in trust after services have been completed and all disbursements have been paid.
Any refund will be calculated based on the value of the unearned portion of the retainer or overpayment, less any disbursements incurred on the client’s behalf.
Refunds are processed by issuing a cheque or electronic transfer to the client’s designated account within 30 days after the final accounting is completed.
Cancellations
A client may terminate our services at any time, subject to the terms set out in the signed Retainer Agreement. Upon termination:
-
An accounting of the trust funds will be provided.
-
Any unearned retainer funds, if applicable, will be refunded after deduction of fees for services already provided and disbursements incurred.
Skyline Legal Services also reserves the right to terminate the retainer in accordance with the Law Society of Ontario’s Rules of Professional Conduct.
In such cases, the client will be provided sufficient notice and will receive an accounting of trust funds.
Non-Refundable Fees
Certain fees are strictly non-refundable, including:
-
Administrative fees
-
Consultation fees where the service has already been provided
-
Filing fees, court fees, government disbursements, and third-party costs already paid on behalf of the client
